Leaves of Absence - Who Gets What?

California has multiple job-protected leaves of absence.  Human Resources professionals must understand how the leaves work, when they apply and when they work together.  Each leave has it's own set of legal requirements for notices, return-to-work, medical certifications and record keeping.

A medical leave of absence is when an employee is granted time off from work due to a medical condition. This leave allows the individual to recover from an illness, undergo medical treatment, or care for a serious health condition without risking their job security. Typically, the duration and conditions of the leave are defined by company policy, employment contracts, or regulations such as the the California Family Right Act (CFRA) or Family and Medical Leave Act (FMLA) in the United States. Documentation from a healthcare provider is usually required to validate the need for the leave. A leave of absence is either paid or unpaid.
